Terms of Service

These Terms of Service ("Terms") govern your access to and use of britedoor.com and all related services operated by BriteDoor ("we," "us," or "our"). By accessing or using BriteDoor you agree to be bound by these Terms. If you do not agree, do not use the platform.

1. Who May Use BriteDoor

You must be at least 18 years old to use BriteDoor. By creating an account, you represent that you are of legal age and that all information you provide is accurate and complete.

BriteDoor serves four types of users: consumers (home buyers and sellers), real estate agents, trusted professionals (lenders, inspectors, title companies, etc.), and broker administrators. Access to certain features depends on your account role.

2. Accounts and Authentication

Accounts are managed through Clerk, our authentication provider. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

You may not share your account with others, create accounts for bots or automated access, or attempt to access accounts belonging to other users. Notify us immediately at support@britedoor.com if you suspect unauthorized access to your account.

3. MLS and Property Listings

Property listings on BriteDoor are sourced from the Houston Association of Realtors (HAR) MLS under a licensed Virtual Office Website (VOW) agreement. By accessing MLS data through BriteDoor you agree to the following HAR VOW rules:

  • MLS data is for your personal, non-commercial use only
  • You may not copy, redistribute, or retransmit any MLS data
  • You may not use MLS data to create a competing property search database
  • Listing information is deemed reliable but not guaranteed
  • All listings are subject to prior sale, change, or withdrawal

BriteDoor is not responsible for inaccuracies in MLS data. Always verify property details independently and work with a licensed real estate professional before making purchasing decisions.

4. Agent and Broker Conduct

Real estate agents and brokers using BriteDoor agree to:

  • Maintain an active, valid Texas real estate license at all times
  • Comply with all applicable Texas Real Estate Commission (TREC) rules and regulations
  • Comply with NAR Code of Ethics
  • Comply with Fair Housing laws in all client interactions
  • Obtain appropriate consent before sending SMS messages or making calls to contacts via BriteDoor tools
  • Not use BriteDoor CRM, dialer, or SMS tools for spam, harassment, or unsolicited mass communications
  • Maintain client confidentiality for all data stored in BriteCRM and BriteFlow

5. BriteCRM and BriteFlow

BriteCRM is a contact and relationship management tool. BriteFlow is a transaction management system. Both are provided as productivity tools only and do not constitute legal, brokerage, or financial advice.

Agents and brokers are solely responsible for the accuracy of data entered into these systems and for their compliance with applicable laws when using these tools to communicate with clients.

Transaction documents generated or managed through BriteFlow must be reviewed by a licensed real estate professional before use. BriteDoor makes no warranty that any templates or checklists comply with current TREC requirements.

6. Communications Tools (SMS and Dialer)

BriteDoor's SMS and power dialer features are powered by Twilio. By using these tools you agree to:

  • Obtain proper opt-in consent from contacts before sending SMS messages
  • Honor opt-out requests immediately (reply STOP)
  • Comply with the Telephone Consumer Protection Act (TCPA) and all applicable federal and state telemarketing laws
  • Not use these tools for automated marketing without proper consent

BriteDoor is not liable for TCPA violations or other regulatory violations resulting from your use of communications tools.

7. Journal Content

Articles, videos, and podcast content in the BriteDoor Journal are provided for informational purposes only and do not constitute legal, financial, or real estate advice. Market data and statistics are subject to change. Always consult a licensed professional before making real estate decisions.

Content published in the Journal is the property of BriteDoor and may not be reproduced without written permission.

8. Prohibited Uses

You may not use BriteDoor to:

  • Scrape, crawl, or systematically download MLS data or any platform content
  • Reverse engineer, decompile, or attempt to extract source code
  • Transmit spam, malware, or any harmful content
  • Impersonate another person or entity
  • Violate any applicable law or regulation
  • Interfere with or disrupt platform infrastructure
  • Use automated scripts or bots without our express written consent

9. Intellectual Property

All content on BriteDoor — including text, graphics, logos, software, and the BriteDoor name and mark — is owned by or licensed to BriteDoor and protected by applicable intellectual property laws. MLS listing content remains the property of HAR and contributing MLS members.

Nothing in these Terms grants you any right to use BriteDoor's trademarks, logos, or branding without our prior written consent.

10. Disclaimers and Limitation of Liability

BriteDoor is provided "as is" without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or that listing data is current or accurate.

To the maximum extent permitted by law, BriteDoor shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or data, arising from your use of the platform — even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or your use of BriteDoor shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless BriteDoor and its officers, directors, employees, and agents from any claim, liability, damage, or expense (including reasonable attorneys' fees) arising from your use of the platform, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any other reason we deem appropriate. You may close your account at any time by contacting us. Upon termination, your right to access BriteDoor immediately ceases.

13. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Harris County, Texas, and you consent to personal jurisdiction in those courts.

14. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms with a new "Last updated" date. For material changes, we will notify registered users via email. Continued use of BriteDoor after changes take effect constitutes your acceptance of the new Terms.
